LIMITATION OF IMPLIED WARRANTIES: RIGHTS UNDER STATE LAW

Except for the expressed warranty provided for hereunder any implied warranty for merchantability and fitness for a particular purpose is disclaimed and the vehicle is otherwise sold "AS-IS WITH ALL FAULTS".  Any implied warranty, including the implied warranties of merchantability and fitness for a particular purpose, is limited to the duration of this warranty.  Some States do not allow limitations on how long an implied warranty lasts, so the above limitations may not apply to you.  This warranty gives you specific legal rights. You may also have other rights which vary from state to state.


DEFINITIONS:

  • "You", "Your" and "Registered Owner" means the Customer identified above

  • The words "We" "Us" and "Ours" means the Dealership identified above

  • "Breakdown" means the immediate and apparent total failure of any Covered Part to work as it was

        designed to work



IMPORTANT NOTICE:

  • You must be with your vehicle when the service arrives as they cannot service an unattended vehicle

  • Services provided must be covered benefits under the terms and conditions described

  • Your coverage is extended to the Covered Vehicle only


EXCLUSIONS:


This is not an Automobile Liability or Physical Damage Insurance Contract.  No coverage is provided for service that is not performed as provided for hereunder


WHAT THIS WARRANTY COVERS:

  1. all internally lubricated parts of the Covered Vehicle's engine, including pistons, piston rings, piston pins, crankshaft and main bearings, connecting rods and rod bearings, camshaft and camshaft bearings, timing chain and timing gears, intake and exhaust valves, valve springs, guides, oil pump, push rods, rocker arms, hydraulic lifters and rocker arm shafts, and

  2. the engine block and cylinder heads, provided the BREAKDOWN of the engine block or cylinder heads is caused by the BREAKDOWN of a part listed in clause (1) above (does not include any part other than what is supplied in Long Block Assembly).

  • Subject to the exclusions listed in the section WHAT THIS WARRANTY DOES NOT COVER and your compliance with all of the conditions set forth in the section WHAT YOU MUST DO TO KEEP THIS WARRANTY IN EFFECT. In the event of a Breakdown of a Covered Part, Dealer will either (1) repair the Covered Part or (2) replace the Covered Part with a new, re-manufactured part or a part of like kind and quality at no charge to you.  The decision to repair or replace the Covered Part or to use new, re-manufactured parts, or parts of like kind and quality shall be at the sole discretion of the Administrator.  All repairs or replacement shall be performed by us, Auto Plaza USA.


DURATION OF THIS WARRANTY:

Subject to your compliance with the conditions set forth in the section WHAT YOU MUST DO TO KEEP THIS WARRANTY IN EFFECT, this warranty lasts until the Covered Vehicle's odometer reaches one million miles.  Coverage under this warranty terminates if you sell or transfer the covered vehicle.  This warranty is not transferable and cannot be canceled.


WHAT YOU MUST DO TO KEEP THIS WARRANTY IN EFFECT:

You must change the oil and oil filter of the Covered Vehicle at your expense every 3 months or 3,000 miles, whichever occurs first, as well as follow the manufacturer's maintenance schedule for all other maintenance service.  You must have this work performed by our Service Department.  If that is not possible, the Dealer must pre-approve a licensed repair facility that regularly performs such work.  If you utilize a licensed repair facility other than the issuing dealer to change your oil and oil filter (Must be pre-approved by Dealer in writing), you must save your receipt(s) so that Auto Plaza USA can verify the work was performed at your next vehicle inspection, as described below. 

You must return the Covered Vehicle to Auto Plaza USA for a free re-qualification inspection at oil change intervals as required.  The inspections will be performed at no charge to you. However, you will be responsible for the oil and filter change.  If the inspection discloses engine malfunction or other operational problems associated with or affecting the Covered Parts that are not otherwise covered by this warranty, but could result in a covered Breakdown if not remedied, you must remedy such malfunctions or problems at your expense within (30) days after the inspection is completed.  You may have such remedial work performed by our Service Department or, if approved by us, by a licensed repair facility that regularly performs such work.  If you utilize a licensed repair facility to perform any required remedial work, you must save your receipt(s) and return the Covered Vehicle to our Service Department within (30) days after completion of the remedial work so that we may verify such work was performed.

You must refrain from altering, tampering with or replacing the Vehicle Identification Number of the Covered Vehicle.  If  for any reason the odometer fails to work as intended, you must immediately have it repaired at your expense. 

IF YOU FAIL TO PERFORM ANY OF THE ABOVE CONDITIONS, THIS WARRANTY SHALL BE NULL AND VOID.


EXCLUSIONS - WHAT THIS WARRANTY DOES NOT COVER:

  • A breakdown caused by contamination of or lack of proper fuels, fluids, coolants, or lubricants.

  • A breakdown caused by manufacturer's defects, including, but not limited to, porous head(s) or block, casting flaws

  • A breakdown caused by a failure to replace seals or gaskets or otherwise to perform maintenance of the Covered Vehicle in a timely manner.

  • A breakdown caused by unauthorized modifications or alterations of a Covered Part, installation of performance accessories to the engine or unauthorized repairs or replacement of Covered Parts in a faulty manner

  • A breakdown caused by overheating, rust, or corrosion

  • A breakdown caused by pre-ignition, pinging, improper lubricants or improper engine adjustments

  • a breakdown caused by collision, fire, electrical fire or meltdown, theft, freezing, vandalism, flood or for any other event insurable under standard physical damage insurance policies, whether or not such insurance is in force with respect to the vehicle. 

  • Loss of use, loss of time, loss of profits or savings, inconvenience, commercial loss, property damage, bodily injury, punitive damages and any incidental or consequential damages or loss of any kind that results from a breakdown.  Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above exclusions or limitations may not apply to you. 

  • Any cost or other benefit for which the manufacturer has announced its responsibility through any means including public recalls or factory service bulletins

  • A gradual reduction in operating performance due to normal wear and tear, including, but not limited to, guides, valves, rings and loss of compression

  • Seals and gaskets are not covered unless required in the repair or replacement of a Covered Part.

  • Repairs covered by the original manufacturer's warranty, provided such warranty has been transferred to you

  • The cost associated with the tear down or diagnosis of a potential breakdown, unless it is subsequently determined that a breakdown covered by this warranty has occurred

  • Any vehicle with over 100,000 miles on the odometer and/or 7 model years old or older at the time of sale


HOW TO OBTAIN YOUR WARRANTY SERVICE:

  • If the Covered Vehicle experiences a breakdown, you must use all reasonable means to protect the vehicle from further damage.  This may require you to stop the vehicle, turn off the engine and have the vehicle towed.  

  • You must make arrangements to deliver the Covered Vehicle to our Service Department at the address shown on page (1) for repairs and present this warranty.  If we do not have a functioning Service Department, we will direct you to an alternate facility.

  • Prior authorization must be obtained by calling us at 859-881-6335 or 859-885-1111 before any repairs are done.

  • The cost of any and all repairs performed by any person or repair facility other than our Service Department or an alternate licensed repair facility approved in advance by us will not be reimbursed under this warranty and may void your coverage under this warranty.

  • If you are unable to deliver the Covered Vehicle to our Service Department or have any questions regarding service under this warranty, you must contact us at 859-881-6335 or 859-885-1111


OTHER IMPORTANT WARRANTY PROVISIONS:

The aggregate total of Dealer's liability for all benefits paid or payable during the term of this limited warranty shall not exceed the average retail value of the vehicle according to current National Auto Dealers Association (NADA) standards at the time of breakdown.  This warranty is not transferable and cannot be canceled.
